An amicus brief was filed by TRALA in the case of Penske Logistics and Penske Truck Leasing v. Mickey Lee Dilts et. al in support of the Penske petition, which is seeking the U.S. Supreme Court's review of a flawed ruling by the U.S. Court of Appeals for the Ninth Circuit. That court held that California meal and rest break requirements are not preempted by a federal law which prohibits states from enacting measures that relate to the prices, routes, or services of motor carriers. U.S. Senators Michael Bennet (D-CO) and Richard Burr (R-CO) have reintroduced a bipartisan bill that would allow liquefied natural gas (LNG) to better compete with diesel with taxation based on energy output rather than per gallon. FULL STORY

 

The TRALA-supported Small Business Regulatory Flexibility Improvements Act of 2015 (HR 527) passed the U.S. House of Representatives by a vote of 260 to 163 and now moves to the Senate.  This bill would require federal agencies to analyze the cumulative effects of their rulemakings, guidance and policy statements on small businesses.  While it is not specific to trucking, it would affect the actions of the Federal Motor Carrier Safety Administration (FMCSA), Environmental Protection Agency and National Highway Traffic Safety Administration. The FMCSA's federally required study on the 34-hour restart will be headed up by Virginia Tech's Transportation Institute which will study two groups of drivers - one to abide by pre-2013 rules and one to abide by the 2013 provisions. FULL STORY

Donaldson has unveiled a new diesel exhaust fluid filter through its Clean Solutions division.  The new filter is designed to remove particulate matter and prevents plugging of dosing valves on SCR systems. FULL STORY

Money Matter$

Rush Enterprises reported record annual revenues of $4.7 billion, up 39.7% compared to $3.4 billion in 2013. FULL STORY

 

Allison Transmission Holdings Inc. reported both profit and revenue for the final quarter of last year and all of 2014.  The company had a net income which totaled $50.5 million in the final quarter compared to $42.9 million a year earlier.  Net sales on the fourth quarter were $544 million, an 11% increase from the same period in 2013. Cummins fourth quarter revenue totaled $5.1 billion, an increase of 11% percent from the same quarter in 2013.  The year-over-year increase was driven by high revenues in North America. FULL STORY

 

Eaton reported an increase in profit in the final quarter of 2014 by 21% from the same time a year ago.  Net income totaled $585 million compared to $482 million. FULL STORY
