Federally pre-empting state vicarious liability laws in 2005 through the enactment of the GRAVES LAW saved our industry hundreds of millions of dollars. The trial lawyers want that money back and they are actively working hard to either repeal the law or overturn it in court. In the just the past year, TRALA defeated legislative attempts in both the U.S. House of Representatives and the U.S. Senate to repeal the Graves Law. Earlier this year the Obama Administration sent draft legislation to Capitol Hill to repeal the Graves Law, and just last week the trial lawyers petitioned the U.S. Supreme Court in an effort to overturn the law. THESE THREATS TO BRING BACK VICARIOUS LIABILITY ARE VERY REAL AND CONTINUE TO BE VERY EXPENSIVE TO FIGHT.
Of course, preserving the Graves Law is only one issue occupying TRALA’s time and resources in Washington, DC. TRALA is fighting overreaching efforts by the Obama Administration to regulate truck renting and leasing companies under the newly formed Consumer Financial Protection Bureau. The Federal Motor Carrier Safety Administration is trying to create new mandates for leasing companies that need to register with the federal government and the National Labor Relations Board wants to issue rules to facilitate union growth in the workplace.
TRALA is also active in aggressively fighting efforts in the states to heavily regulate and tax the truck renting and leasing industry. California wants every rental truck in the state to undergo odometer accuracy testing that may have to be repeated on a county-by-county basis. In the past year, Arizona, Colorado, Florida, New York, Oregon and South Carolina have all proposed new taxes aimed directly at the truck rental and leasing industry. Other states, including New York and Florida, have proposed mandating higher insurance requirements for rented and leased vehicles.
Regardless of the issue or the jurisdiction, TRALA needs to be ready to wage and win multiple and simultaneous legal and legislative battles to protect our industry and to provide a fair and competitive environment for business. Contributions to TRALA's Legal Action Fund are deductible as a business expense for most members. However, TRALA estimates that 10% is not deductible because of TRALA's lobbying activities.
