Canadian Vicarious Liability Reform

The Alberta province has joined Ontario and British Columbia in passing legislation significantly reforming vicarious liability laws that previously exposed owners of rented and leased vehicles to unlimited liability. As part of the implementation process in Alberta, TRALA is seeking regulatory language making the operator of a rented or leased vehicle the primary insured. TRALA is also seeking the enactment of new legislation in Alberta extending vicarious liability reform protection already in place for long-term lessors to owners of vehicles under short-term rental agreements.
